อธิบดีสรรพากร ยันปีนี้เก็บภาษีขายหุ้นแน่เตรียมชง รมว.คลัง เร็วๆ นี้

นายเอกนิติ นิติทัณฑ์ประภาศ อธิบดีกรมสรรพากร เปิดเผยว่า กรมสรรพากรอยู่ระหว่างการเร่งศึกษาการจัดเก็บภาษีจากการขายหุ้น ตามนโยบายของกระทรวงการคลัง หลังจากที่ผ่านมาได้ยกเว้นการจัดเก็บมา 30 ปี แต่คงต้องพิจารณาแนวทางการจัดเก็บให้มีความเหมาะสมที่สุด โดยธนาคารเพื่อการพัฒนาเอเชีย (ADB) ได้ส่งผู้เชี่ยวชาญมาช่วยทำการศึกษาแนวทางเพื่อให้มีรูปแบบการจัดเก็บภาษีที่เป็นไปตามมาตรฐานสากล

ปัจจุบัน ในต่างประเทศมีการจัดเก็บภาษีหุ้นใน 2 รูปแบบ คือ 1. เก็บจากส่วนต่างของกำไร (Capital Gain) ซึ่งมีข้อดี แต่การดำเนินการยุ่งยาก เป็นภาระกับผู้เสียภาษีมากกว่า หากกรมสรรพากรดำเนินการรูปแบบนี้จะต้องออกระเบียบและแก้กฎหมายใหม่ และ 2. เก็บจากธุรกรรมการซื้อขายหุ้น ซึ่งกลุ่มประเทศอาเซียนส่วนใหญ่จัดเก็บวิธีการนี้

สำหรับแนวทางการจัดเก็บภาษีจากธุรกรรมการซื้อขายหุ้นน่าจะเหมาะสมกับประเทศไทยมากที่สุด โดยในต่างประเทศจัดเก็บทั้ง 2 ขา ทั้งขาขายและขาซื้อ แต่ในส่วนของไทยศึกษาการจัดเก็บจากการขายหุ้นฝั่งเดียวเท่านั้น ซึ่งภาระไม่ได้มาก อัตราจัดเก็บที่ 0.1% เท่ากับหากมีการขายหุ้นมูลค่า 1 ล้านบาท จะเสียภาษีเพียง 1,000 บาทเท่านั้น

"จะเสนอแนวทางการศึกษาทั้งหมดให้ รมว.คลัง พิจารณาในเร็ว ๆ นี้ ซึ่งการจะเริ่มเก็บภาษีต้องดูสภาพตลาดหุ้นด้วย ต้องยอมรับว่าแม้จะมีการระบาดของโควิด-19 ในช่วง 2 ปีที่ผ่านมา แต่ตลาดหุ้นไทยก็มีดัชนีเพิ่มขึ้น และมูลค่าการซื้อขายก็เพิ่มขึ้นด้วยเช่นกัน ดังนั้นมองว่าหากมีการจัดเก็บภาษีจากการขายหุ้นในปีนี้ ก็ไม่น่าจะส่งผลกระทบกับตลาดหุ้นไทยมากนัก" อธิบดีกรมสรรพากร กล่าว
พร้อมระบุว่า การเก็บภาษีหุ้นไม่ได้มุ่งหวังเรื่องของรายได้เพียงอย่างเดียว แต่เป็นการสร้างความเป็นธรรมในระบบภาษีด้วย เพราะเป็นการเสียในรูปแบบภาษีธุรกิจเฉพาะ ซึ่งปัจจุบันธุรกิจธนาคารพาณิชย์ บริษัทประกัน การซื้อขายอสังหาริมทรัยพ์ ก็ต้องเสียภาษีธุรกิจเฉพาะทั้งหมด ไม่ได้รับการยกเว้นแต่อย่างใด ซึ่งภาษีหุ้นก็อยู่ในหมวดธุรกิจเฉพาะที่จะต้องเสียภาษีในอัตรา 0.1% เพียงแต่ที่ผ่านมาได้รับการยกเว้นมานานถึง 30 ปี
